摘　　要：随着高校科技创新能力的不断增强,保护高校自主知识产权问题日益引起人们的关注。在陕西高校科技创新过程中,专利权归属问题是造成权利纠纷和影响科技创新的一个重要因素。针对我国职务发明法律规定的不足,对完善陕西高校职务发明权专利权归属问题提出建议。As the capabilities of college scientific and technological innovation have been enhanced, the protection of proprietary intellectual property rights has been paid more and more attention to. Among such innovations in Shaanxi colleges, the ownership of service invention patents right is an important factor that causes disputes and influences the scientific innovations. This paper analyzes the problems on the systems δf service invention. It puts forward some suggestions on how to solve the problems in the ownership of service invention patents right in Shaanxi colleges, making advantage of related foreign laws.
