摘　　要：欧盟是由条约创建和发展起来的,是依照由条约及欧盟机构依条约制定的法律组成的欧盟法进行治理的。欧盟法直接效力和最高效力的确立,不但保障了欧盟法效力的实现,更使欧盟法成为有别于其他国际条约的独特的法律,形成了欧盟独特的超国家法治。《欧盟宪法条约》将欧盟法治以基础条约的成文法形式加以巩固,更彰显了法治之于欧盟发展的重要意义。欧盟法治的形成与发展伴随着欧洲区域经济一体化向广度和深度的发展,是欧洲区域经济一体化发展的重要保障。The European Union was shaped through the functions of treaties, and has functioned according to the EU law consisted of the treaties and secondary law adopted by the Eu.The establishment of the direct effect and supremacy of the EU law safeguards the effectiveness of the EU law and also made the EU law a unique type different from other international laws, so as to realize a special kind of super-national rule of the EU law.The treaty of establishing a constitution for Europe made the rule of law be a basic principle of EU, showing clearly the importance of the rule of law to the EU development.The creation and development the EU rule of law is an important sufeguard of the economic integration of EU.
