摘　　要：改革开放30年来,不仅要总结中国出国留学事业取得的成绩,更要认真反思存在的问题。对出国留学政策的批判性法律思考揭示,不健全和不完善的出国留学政策部分导致了出国留学事业存在的问题。解决出国留学政策存在的法律问题,必须依靠法治和依法行政。After 30 years of reform and opening up, we should not only see the achievements brought by our policies toward studying abroad, but also examine the existing problems. A critical legal review of the past reveals that imperfections in our policies led to those problems.To solve the problems, we must rely on the law as well as administration based on the law.
