摘　　要：介绍了专利失效的原因及失效专利的种类,分析了免费专利的效用和利用价值,阐述了免费专利的获取,论述了应用免费专利时应注意的问题。This paper introduces the reasons why the patent loses its effectiveness and the kinds of the invalid patents, analyzes the functions and use value of the free patents, expounds the acquisition of the free patents, and discusses some problems needing attention in the application of the free patents.
