摘　　要：劳动教养制度问题是近年理论界争论激烈的问题之一,随着禁毒法的实施,劳教制度面临着巨大的挑战。在新的历史关口,劳动教养的出路在何方?首先在方法上,必须要有创新,其次在立场上,必须处理好几种关系:理论研究者与制度的决策者、执行者之间视觉上的关系;制度设计与制度实际运作之间的关系;西方化与本土化关系等。在此立场上,再进行制度的选择和设计。The issue of reeducation through labor system has always been a hot topic in the theoretical circle. As the enforcement of Anti-drug Law of People＇s Republic of China, the reeducation through labor system in China is facing great challenges. At the historical transaction, the author makes an effort to search some solutions to such problems and puts forward suggestions on the development of reeducation through labor system in China.
