国家与农民关系视野下的制度落实与创新--中国农村村民自治20年的成长逻辑

摘　　要：农村基层社会的矛盾是推动村民自治发展的内在动力,中国农村村民自治制度是在基层农村社会的矛盾冲突和协调的过程中产生、发展并逐步完善的。本文把村民自治放在国家与农民互动关系的视野下观察,展现了中国农村村民自治从无到有、从形式到实质、从集权到放权、从选举到治理的过程中,国家不断根据农民的需求做出的策略选择,从农民依法抗争的视角解释村民自治的成长逻辑:在抗争中落实,在实践中创新,在创新中完善。The contradictions of rural society are the intrinsic motivation to promote the village self- government, and the rural village self - government system is produced, developed and improved step by step during the conflicts and coordinative processes. This paper, from the version of relationship between the state and farmers, shows the village self-government process from nothing to grow out, from form to substance, from centralization to decentralization, and from election to governance, during which the state constantly makes strategies based on farmer＇s needs. From farmer＇s protest in accordance with laws, it explains a village self - government growth logic ： implementation in protest, innovation in practice and improvement in innovation.
