摘　　要：形势异常复杂、多变,立法机关不可能预见社会治安形势的全部以及公安行政执法活动可能发生的所有影响。因此,法律不得不授权公安机关在法律原则指导下,执法主体根据具体情况斟酌权衡从而采取适当的措施。本文从公安行政自由裁量权的理论内涵入手,在探讨公安行政自由裁量权适用原则和存在情形的基础上,分析了公安行政自由裁量权存在的合理性和必要性。结合公安机关行使自由裁量权过程中存在的主要问题,深入剖析了问题成因,探索性的阐述了当前形势下对公安行政自由裁量权实施有效规制的途径及对策。The modern public security administration is facing a very complex and changeable public order situation. The legislature can not foresee the entire public order situation as well as all effects that may occur in the public security administrative law enforcement activities. Therefore, the law had to authorize the public security organs under the guidance of the principles of law, law enforcement under the specific circumstances of the main trade-offs to take appropriate measures. This article started from the theoretical connotation of public security administrative discretion to explore the public security administrative discretion to apply the principles and the existence of the case, and to analyze the rationality and necessity of the existence of public security administrative discretion. Combining the main problems of public security organs in the exercise of discretion, the article in-depth analyzed the causes of the problems; exploratory described the means and countermeasures to implement an effective regulation to the discretionary power of public security administration in current situation.
