欧盟贸易壁垒条例保护知识产权的法律与实践——以“美国音乐作品许可案”为例

摘　　要：通过美国音乐作品许可案分析了欧盟贸易壁垒条例在知识产权保护这一领域运用的具体情况,指出其对知识产权保护是以严格遵守TRIPs协议及其他相关国际公约为基础的,我国可在知识产权案件的调查取证、公共利益认定等方面借鉴欧盟贸易壁垒条例的经验,挖掘《对外贸易壁垒调查条例》在知识产权保护中的潜力。The paper analyzes the function of the TBR in protection of intellectual property rights via a case study of the Licensing of Music Work in the United States of America, and points out that the protection to intellectual property rights by the TBR is based on the strict commitment to TRIPs and other international intellectual property right conventions. The paper also concludes that China can make use of the wealth of experience accumulated by the practice of the TBR in investigation, evidence collecting and public interest defining so as to tap the potentialities of China＇s Rules and Regulations on Foreign Trade Barrier Investigation in intellectual property rights protection.
