摘　　要：1997年刑法增设了"铁路运营安全事故罪",这对有效惩治铁路交通业务过失犯罪具有十分重要的意义。但是,相关法律及司法解释对本罪的罪名、罪状、定罪标准、可否由危险犯构成、罪刑均衡以及此罪与彼罪的区别等诸多方面的相关规定不合理或缺乏具体规定;本罪罪名应概括为"铁路交通肇事罪",罪状应反映特殊业务过失犯罪的性质,定罪标准则须明确"严重后果"并加重处罚以使罪刑均衡,另外也应将本罪与交通肇事罪、重大责任事故罪等相近罪名的区别。The crime of railway operation safety accident was added to the 97＇ Criminal Law. It was of great significance in punishing the crimes of dereliction of duty in railway traffic operation. However, the related law and judicial interpretation is insufficiently rational and concrete in the crime term, description, standards of prosecution, dangerous crime composition, equilibrium of punishment and crime, and crimes distinction. The crime of railway traffic accident is a general term, which reflects the feature of various negligent crimes in the field, and the standards of prosecution should emphasize on ＂serious results＂ and enhance penalties to equilibrate punishment and crime. And it is also necessary to distinguish the crime from other similar crimes, such as the crime of traffic accident and the crime of serious accident and so on.
