摘　　要：不利于构建和谐社会的民间债务纠纷时有发生,这与个人破产能力的阙如有关。现代破产法是一种理性的市场退出机制,它对各相关方提供平等的机会,甚而有时偏好对债务人利益的保护。赋予个人破产能力的理论基础是实现公平,现实需求为经济增长与负产阶层的涌出,国际背景在于吸收国外相关立法的成功经验。赋予个人破产能力,符合构建和谐社会的总要求。The fact that the occasional liability disputes has to do with the absence of capability of individual bankruptcy. And the modem law of bankruptcy is actually a mechanism for the rational withdrawal from the market. It provides an equal opportunity for all the parts concerned, and is even partial for the protection of the interests of the debtor. It is, therefore, an overaU demand for the construction of harmonious society to provide capability of individual bankruptcy.
