人大代表人身特别保护权制度的立法缺陷与完善

摘　　要：我国宪法和法律规定各级人大代表享有人身特别保护权,体现了民主法治社会中民主价值与法治价值之间的协调原则。但这种保护在立法上有较大缺陷:如许可权的内容缺少统一规定,有些法定许可程序在实践中缺乏可操作性,许可权的行使缺失程序性规范。从许可内容,许可程序,报请、报告程序三方面提出了完善建议。China＇s Constitution and laws of people＇s deputies at all levels enjoy special protection for personal rights,democracy,rule of law embodies the social values of democracy and the rule of law in the value of coordination between the principle.However,such legislation on the protection of a greater flaw： If the right to license the content of the lack of unified regulations,some of the statutory licensing procedures in practice the lack of operation,licensed the right to regulate the exercise of procedural deficiencies.Permission from the author,licensing procedures,reporting,reporting procedures in three areas by improving the proposal.
