构建我国保安处分制度的设想

摘　　要：受我国刑事政策理论的影响,我国保安处分制度的法制化应采取二元制的立法模式,使保安处分与刑罚制度并存,共同发挥预防与控制犯罪的作用。保安处分制度的适用一是要有客观违法事实,二是要有主观人身危险性。保安处分制度的种类有教养处分、强制医疗、少年保护、强制禁戒、监督考察、没收罪物等项内容。Influenced by the criminal policy theory, China＇ s security measure system should adopt the dual legislative mode, which makes the security measures coexisting with penalty system to prevent and control crimes. Security measures include reeducation punishment, compulsory medical treatment, juvenile protection, supervision and confiscation.
