论房地产权属登记与房地产买卖合同效力的关系

摘　　要：从物权法来看,房地产权属登记仅是物权变动的要件,并不影响买卖合同的效力;从债法来看,房地产买卖合同的效力只能以合同的生效要件为判断依据,房地产权属登记不是合同的生效要件,不应当影响买卖合同的效力。Taking it from properly law. real properly registration is only the essential of real right alteration. It doesn＇t influence the validity of sale contract;Taking it from contract law, the validity of real property sale contract can only be judged by the executing essentials of contract. Real property registration isn＇ t the executing essential of contract and doesn＇ t influence the validity of sale contract.
