摘  要:文章在界定失地农民小产权房内涵的基础上,从建立城乡统一的房地产市场的思想出发,具体分析了失地农民小产权房市场现存在的几大问题及其成因,提出了基于我国城乡二元社会的具有二元结构特征的土地法律制度是产生小产权房的内在制度基础;乡政府、村委会在土地制度不完善的情况下的获利动机及行为是小产权房产生的供给动力;城市低收入阶层的住房需求是小产权房产生的需求动力;土地管理部门的监管不到位是小产权房市场得以形成和发展的外部条件。最后提出规范失地农民"小产权房"市场的规范化措施。Based on the definition of landless peasants'house with imperfective property rights, the paper put forward some key issues and discussed the internal reasons with the view of an urban-rural uniform real estate market. Then, some conclusions and implications were pointed out. The paper viewed that,a) the land laws and systems with the dual structure of urban-rural economy were the internal institutional basis of producing the house with imperfective property rights;b) the initiative of pursuing the maximum profits of township government or village committee in imperfective land system was the supply drive of producing the house with imperfective property rights;c) the house demands of urban residents with lower income was the impetus of producing the house with imperfective property rights; d) the poor supervision of the land administrative departments provided the advantageous condition of causing the serious issues. Finally proposed that the standard of land-lost peasants'houses market with imperfective property rights.
