协商:一种解决土地征收补偿问题的行动选择——以河南省D镇为例

摘　　要：文章通过对河南省D镇集镇规划实施过程中政府与农民就土地征收补偿价格进行协商的调查分析后认为,遵守法律法规是成功协商的前提,尊重对方的主体地位是协商的根本,理性的提出要求和积极给予回应是达成共识的关键。因此,文章最后提出,完善法律法规,促进村民文化资本的积累,加快农民自身组织建设,真正落实农民的话语权,是解决由征地补偿和安置问题所引发的征地纠纷问题的最佳行动选择。After the investigation and analysis of how the local government of D town in Henan province negotiates with the farmers about the compensation price for land expropriation when implementing its layout plan, a safe conclusion can be drawn that compliance with laws and regulations is a prerequisite for the success of the consultation, respecting each other＇s dominant position is the basis of consultation, reasonable requests and positive responses is the key to reach a consensus. As a result, this article concludes that the best course of action to solve the dispute caused by expropriation compensation and allocation is to improve laws and regulations, to promote the accumulation of villagers＇cultural capital, to speed up their own organizational building and to let the farmers voice their own views.
