WTO框架下反补贴规则研究——兼论我国应对反补贴调查的策略

摘　　要：随着加拿大和美国相继突破"反补贴不适用于非市场经济国家"的定论,向我国出口产品展开反补贴调查,国外对我国出口产品实施新的贸易保护手段——进行大量反补贴调查已经从潜在的风险正逐步转变为现实的威胁。为此,寻求应对国外反补贴调查的策略已迫在眉睫。从补贴的基本概念入手,在分析我国遭遇反补贴调查原因的基础上,指出我国目前有关反补贴法律制度的不足,同时为我国应对即将到来的大量反补贴调查提出些许建议。With the breakthrough in Canada and the United States that ＂Counter - veiling measures does not apply to non - market economy countries＂, China＇s export products undergo Counter - veiling measures investigations. China＇s export products face the implementation of the new trade protection measures - a lot from Counter - veiling measures investigations. Potential risks are gradually changing for the real threat. For this reason, Counter - veiling measures investigations abroad should seek the response. This article analyzes subsidies from the basic concept, the experience of China＇s Counter - veiling measures investigation on the basis of the reason, and pointed out the lack of China＇s current legal systems related to Counter -veiling measures. Meanwhile, some suggestions are made for China＇s response to the upcoming massive Counter- veiling measure investigations.
