摘　　要：在工程总承包和项目管理工作中,首先是立法在引导市场进步上存在着一定的缺陷,致使难以在我国形成工程总承包的主流模式。对工程总承包立法的必要性进行了分析。In the project general contracting and project management work,some defects exist in the legislation to guide the market,s progress first of all. Therefore,it is difficult to form the mainstream of the project general contracting mode in China. The necessity of legislation is analyzed.
