摘　　要：从一元论和二元论的内涵入手,可以发现,两种理论概括在对国际法与国内法分析中都陷入了主权国家的思维局限,不能对现今全球化时代下的国际法发展作出合理的解释。对国际法与国内法的关系应作出一种对立统一的描述。Proceeding with the connotation of monism and dualism, this article intends to analyze that both of the two kinds of theoretical generalization have fallen into the thinking limitation of the sovereign state regarding the analysis of the international law and the municipal law, and neither of them can provide rational explanation on the development of international law in the globalization era nowadays. The relationship of the international law and the municipal law should be described in a unity of opposite way.
