摘　　要：现有技术在专利实质性授权体系中占有重要地位,近年来,专利制度的国际协调越来越重视现有技术制度,出现了从信息的角度对现有技术定义的趋势。现有技术本质上是技术信息,从信息的角度,现有技术制度需要规范的两大对象为:技术信息及其载体——技术公开行为。现有技术应当是从所属技术领域一般技术人员的视角,将所有符合法律要求的技术公开行为作为整体解读出的技术信息整体。Prior Art, one of the important parts of the substantive patent-granted condition system, has been gaining the attention of the international harmonization of patent system, in which defining and regulating prior art from the perspective of information becomes a trend. In essence, Prior Art is technical information. It should be the whole of the technical information, available by the general personnel of respective technical areas, from as a whole all the technical disclosures in line with the legal requirements.
