构建我国离岸金融市场的法律思考

摘　　要：离岸金融市场作为半个世纪以来全球最大的金融创新,给世界上许多国家带来了巨大的利益,并成为了现代金融的重要组成部分。作为发展中国家,我国亦可通过建立离岸金融市场为国内经济发展做出贡献。但离岸金融市场所蕴含的风险因素可能导致金融市场的动荡和危机,因此如何对离岸金融市场加强监管,避免其风险的发生就成为目前亟需研究的问题。文章从构建我国离岸金融市场的战略意义入手,在分析离岸金融市场风险因素的基础上,对完善我国离岸金融市场法律监管制度提出些许建议。Offshore financial market,as the world＇s largest financial innovation over past half a century,has brought tremendous benefits for many countries in the world,and becomes an important modern financial sections.As a developing country,China can also make contribution to domestic economic development by establishing offshore financial markets.However,the risk factors behind off-shore financial markets might lead fluctuation and crisis to the whole financial markets;hence,how to strengthen supervision on off-shore financial markets in order to avoid occurrence of risk becomes urgent issue to be researched into for the present.This article,by taking advantage of building the First Offshore Financial Center in TianJin,in light of embarking on strategic significance of constructing Offshore financial markets,based on the analysing the riskan factor of the offshore financial markets,puts forward many suggestions on perfecting legal supervision system over offshore financial markets in china.
