摘　　要：在公安执法实践中,公安行政处罚程序对于规范公安机关行政处罚权、保障公安机关依法行政、保护相对人合法权益,具有重要的意义。但由于我国行政程序立法研究理论的欠缺和现实条件的制约,当前的公安行政处罚程序中仍存在着一些问题,急需法律予以规范和指引。In the practice of poliee＇s law enforcement, the procedure of the public security ad- ministrative punishment has an important meaning on regulating the right of the public security organs to administrative penalties, on guaranteeing police＇s administration according to law, on protecting counterpart＇s legitimate rights and interests. However,due to the lack of China＇s administrative procedures of the legislative theory research and practical conditions＇restriction, there are still some problems on the current public security administrative punishment proceedings, which is in urgent need of legal norms and guidelines.
