改革开放以来中国乡村行政法治化的成效考察

摘　　要：改革开放以来,随着国家法治化宏观背景的日渐清晰,乡村行政权力的运行正逐渐转入依法行政的法治轨道,乡村行政法治化取得明显进展,主要表现在:依法行政正在成为乡村行政主体的普遍观念和自觉行动;非强制性的服务行政逐步成为乡村行政的主要方式和重要内容;正当性法律程序的观念和原则开始在乡村行政过程中得到贯彻和体现;行政法制监督在保证和促进乡村依法行政中的作用逐步加强。Since the reform and opening-up, and with the macro-background of government by law becoming clearer, the administration in rural areas has also gradually stepped onto the track of lawgoverning administration, and has made several distinct progresses, which are （1） the law-governing administration is becoming a universal concept and self-conscious behavior of local governments in rural areas; （2） non-coercive service-oriented administration is becoming the main methods and contents of administration of local government in rural areas; （3） the concept and principle of rightly law procedure is reflected and implemented in the administration of local government; （4） the functions of law supervision on administration in guaranteeing and enhancing the local legal administration is becoming stronger.
