论单位经济犯罪案件的立案标准——以金融犯罪案件为视角

摘　　要：单位经济犯罪案件的立案标准,是经侦理论和实践的一个难题。单位经济犯罪是个人经济犯罪的对称,讨论单位经济犯罪案件的立案标准要结合个人经济犯罪案件的立案标准进行。我国现有司法规范规定的单位经济犯罪案件立案标准与个人经济犯罪案件立案标准的比例关系存在不合理之处,需要对单位经济犯罪案件的立案标准进行重新梳理,确定新的比例关系,即单位经济犯罪案件的立案标准应与个人经济犯罪案件的立案标准相一致。The economic crime by unit is opposite to the personal economic crime. There are unreasonable proportions between the case-filing criteria on the economic crime by unit and the personal economic crime in the existing judicial norms of our country. It is necessary to set up a new proportion, namely the ease-filing criteria on the economic crime by unit and the personal economic crime should be identical.
