摘 要:清末司法独立思想的端倪,其出现大致可分为三个阶段。它在演进上体现为:从类似大众常识性启蒙,到以观念的解释论证来说服民众,再到政治层面上强烈地批判时弊、提出建议。在思想动因中,"内在视角"的研究更为根本,"国家意识"的觉醒与原创的"独立司法"思想值得关注。从思想的引入途径可以看出,清末司法改革具有强烈的西方化倾向,在一定程度上反映了一种激进的态势,正因如此,中西法文化并不能很好地自觉融合。The ideological orientation of judicial independence of late Qing dynasty can be divided to three stages. In its developing courses, it ranges from such as a popular common sense to convince the people with the explaining and argumentation to the conception, to animadvert on the social problem fiercely and give some advice from political lay. In the cause of ideology, the research from internal view is more essential, as the wake of nation - consciousness and the original thought of judicial independence is worth to attention. From the importing approach of the ideology, we can know that the judicial reform of late Qing dynasty had a obvious tendency of westernization, which was reflected to be a jacobinical form in some way, and because of that, the law culture of China can' t combine with the law culture of west very well.
