摘　　要：医疗纠纷中的尸解工作难以进行,其主要原因是相关法律制度不完善。对致死性医疗纠纷的司法(行政)裁决,应首先进行程序性审查。死者近亲属若拒绝或拖延尸体解剖,应视为医疗单位的免责条件。The work of An Autopsy In The Therapeutic Dispute is a hard job to conduct and its main reason is the incompleteness of the related legal regulation. To judicial (administration adjudication, it should in the first place carry on procedural examination. If the close relative refuses or delay the autopsy of the dead this should be consider as a situation of duty-avoiding to the therapeutic unit
