摘　　要：阐述船舶避难场所制度对海洋环境、周边居民的安全、沿岸国经济和社会利益产生的潜在影响,介绍中国针对该制度在立法和管理框架上的现状,给出一系列针对船舶避难场所制度的建议,包括建立一个综合的海事机构,修改现行法律,建立损害赔偿基金,预先指定避难场所,建立国家层面的海事数据库,引入海事交通控制图像监控体系等.This paper described Chinese government's main con- cerns for this customary law on places of refuge,including po- tential damage to maritime environment,safety of local inhabit- ants,economic and social interests of coastal states.The status quo of places of refuge in China was discussed in terms of legisla- tion and management framework.Recommendations for Chinese approach toward places of refuge are offered,such as establish- ing a centralized maritime authority,amending existing domestic law,establishing a fund for the compensation for victims,pre- designating places of refuge,establishing a national maritime da- tabase,introducing a maritime traffic control photographic and detector system,etc.
