论我国成年人监护制度的法律完善

摘　　要：我国现行的成年人监护制度在为保护成年障碍人和维护交易安全方面发挥了重要作用,但在立法理念上仍有违背民法基本特征之处,在制度构建上仍存在一些缺陷。本文根据成年障碍人的生理及心理特征,通过对德国和日本成年人监护制度改革的分析,反思我国成年人监护制度,以完善我国民法典体系为前提,建立符合我国国情的成年人照管制度。Our country's present adult guardianship system has played the vital role for the protection of adult incapacity person and security transaction,but there still have some legislation ideas that violate the civil law basic characteristic place,and some flaws in the system constructed.According to physiology and psychological characteristic of the adult incapacity person,and through the analysis of German and Japanese adult guardianship system reform,this article reconsiders our country adult guardianship system,and establishes the Adult Care System,which suits our national condition and based on the premise of perfecting our country's Civil Code.
