摘　　要：行政执法主要是通过行政法律适用活动实现的,本文从能动的行政入手,采用比较和实证分析的方法,对行政法律适用的有关问题进行了研究。指出行政法律适用的要求包括合法性要求和正当性要求并重点论述了比例原则,论证了行政法律适用的思路是确定方案、收集分析、比较鉴别、预测后果。提出了行政法律适用的方法有价值分析的方法、比较的方法、逻辑分析的方法、经济分析的方法。Administrative enforcement of law is mainly realized by the application of administrative law. The article studies some questions concerning the application of administrative law by means of comparison and factual analysis and points out that being legal and proper are the two demands for the application. Meanwhile, it expounds the train of thought and puts forward ways of the application.
