浅议彩票兑奖期限制度的完善

摘　　要：在中奖者过期未兑奖时,彩票中心的拒付行为并不侵犯中奖者财产所有权,从合同法角度而言,体彩中心规定的兑奖期限的规定并非无效的格式条款。但权衡彩票事业的公益性、操作上的技术性以及中奖者的利益,彩票行业应当引入中奖者在特定情况下可延长行使兑奖权利的机制并适当延长兑奖期限。The winner had exchanged his prize in the period, the lottery＇s central refused to pay, which did not violate owner＇s property ownership. From the view of contract law, the provisions about exchanging period offered by the Lottery＇s central is not invalid. But in order to balance the public welfare of the lottery, operation on the technical and the interests of the winners, we should introduce specific cases, which may extend the deadline. Only by doing this, can we protect winner＇s right.
