摘　　要：通过对责任保险中第三人请求权应否存在的探讨 ,比较、分析了不承认第三人请求权的弊端 ,阐述了承认第三人请求权存在的法理基础及其存在的积极现实意义 ,及《保险法》修改责任保险相关内容的必要性。Through the exploration on whether the claiming right of the third party exists in liability insurance or not, the author analyzes the disadvantages of not admitting claiming right of the third party, elaborates the legal basis and practical significance of its existence, and explains the necessity of revising the contents of liability insurance in Insurance Law.
