摘　　要：违法分包及非法转包是建筑工程发包和承包的涉及的主要问题,我国《建筑法》、《合同法》及《建设工程质量管理条例》等法律法规对于工程分包和转包明确规定了适用的原则和效力,但在建筑工程市场上仍存在大量的非法分包和违法转包现象,严重干扰建筑市场的正常秩序。The illegal subcontracting and the illegal contract transformation are the main concerns involved in contract construction. Although the application and effectiveness of subcontracting and contract transformation are clearly defined by law and regulations such as the Construction Law of the People＇s Republic of China and Regulations on the Administration of Quality of Construction Projects, the illegal subcontracting and the illegal contract transformation as common phenomena still seriously interfere with the order of construction market.
