摘　　要：法律援助行为性质的演变及法律援助权的产生和发展有其历史背景、动因及条件,法定权利意义上的法律援助权的生成有其内在动力。法律援助制度是始终围绕诉讼活动而设计的,法律援助权是诉权的保障权。保障公民诉权得以完整行使的社会需求是法律援助权生成的深层次动力。法治社会应围绕保护公民诉权的充分行使来设计符合时代需求的法律援助制度。It is obviously seen that there are certain historical backgrounds, motives and conditions for the birth and development of the right of law help, and that certain inner forces pushed the production of legal assistance rights. The legal assistance rights designed around the procedural practice, and were the guaranteeing rights for the procedural rights. The social needs of gnaranteeing citizens＇ litigious right is the inner impetus of generating the legal assistance system. Legal society should design the legal assistance around how to realize the citizens＇ litigious rights fully.
