论“媒体审判”对司法的影响——以湘潭“黄静”案为视角

摘　　要："媒体审判"指新闻媒介对尚未最终裁决的案件进行广泛报道并流露出倾向性结论而对司法机关形成舆论压力的情况。从"黄静"案的审理可以看出,"媒体审判"在我国不仅已经存在而且能量巨大,对司法独立和司法公正都有影响,应该正确予以引导。News Media trial means the news media have so widely reported the cases in which the court has not made final verdict and showed tendentious opinions that the pressure of public opinion to the judicial apparatus e- merged. It can be seen from the ＂Huang Jing Case＂ that the situation of news media＇s trial not only exists in China, but also has tremendous energy. Because of its impact to the judicial justice, it should be guided correctly.
