摘　　要：海域使用权是一新颖的物权,且属于典型物权中的用益物权,而非准物权。它同渔业权存在着效力冲突,其实渔业权本可被海域使用权吸收。为此,本文试就海域使用权的内容、性质以及与土地权并列的不动产权类型等,来探讨《物权法》存在的弊端,进而从海域物权法律制度设计提出一些建议。The right to use the sea areas is a new rights, and it is classified as a typically usufructuary rights, rather than qua- si-property fights. It has a validity conflict to fishery fight which indeed can be enrolled by the fight to use the sea areas. Therefore,this artical trys to discuss the depects of Property Law by studying the contents, nature, and immovable property fights tied with land rights from the fights to sse the sea areas, in order to propse some suggestions from the system of the fight to use the sea areas.
