摘　　要：著作权的发展始终伴随着传播技术的发展而不断发生着改变进行着相应的调整,合理使用制度作为保护作者和其他著作权人利益与促进信息广泛传播的利益平衡机制,随着网络技术应用的不断深入和普及,合理使用制度面临网络技术的考验,网络作品对合理使用的挑战和网络技术与合理使用之间的关系对合理使用制度提出了新的要求,合理使用制度必须与技术手段一道发挥作用,对网络环境下的著作权进行再平衡。The development of the copyright changes and makes corresponding adjustment along with the development of transmission technology. Fair use system, as a benefit balance mechanism of protecting the interests of authors and copyright owners and of promoting the widespread of information, is facing the challenge of network technology with the deepening and popularization of network technology application, The challenge of the network works on fair use and the relationship between network technology and fair use system present new requirements that both fair use system and network technology bring into play to rebalance copyright under the network environment.
