摘　　要：研究目的:基于中国农村集体建设用地流转的现状和问题之分析,探讨流转治理的路径选择。研究方法:实证分析和规范分析方法。研究结果:中国农村集体建设用地流转试点在某种意义上突破了现行《土地管理法》,必须要有全国性的法律予以回应。研究结论:合法化、民主化和市场化是中国农村集体建设用地流转治理的路径选择。The purpose of the study is to explore possible regulatory paths in rural collective land circulation basing on analysis of the current situations and problems of China＇s rural collective construction land. Methods of Empirical analysis and normative analysis were employed. The results show that rural land circulation in some pilot areas has in some degree broken through the regulations of the current Land Management Law. Therefore, a national legislation must be conducted to manage this. It is concluded that the legalization, democracy and marketization measures are path selections to regulate rural collective land circulation for construction.
