服务型政府视角下的应急救助及行政法的回应

摘　　要：服务型政府已成为我国当代政府治理的发展模式和目标,应急救助是非常状态下政府提供的一种特殊服务,两者具有内在的契合性。目前,我国的应急救助处在按照服务型政府的要求转型的过程中,仍存在规范化和法制化程度偏低的问题,进而影响了应急救助制度的功能发挥。因此,我国应尽快制定《应急救助法》,同时加强对应急救助及行政救助的行政法研究。It becomes development pattern and goal of our governance to be a service-oriented government. Emergency assistance is a kind of special service of governments under extraordinary states. There is inherent correspondence between service-oriented government and emergency assistance. Now our emergency assistance system is changing according to the demands of the service-oriented government. But its degree of institutionalization and legalization are lower, and these problems affect its function to exert. So we should constitute Emergency Assistance Law as soon as possible, and enhance the administrative law research on emergency assistance as well as administrative assistance.
