摘　　要：随着我国法治进程的推进,权利冲突已经成为非常普遍的法律现象,如果不能及时遏制并解决权利冲突,法治现代化进程就会受到影响。权利冲突是不同的权利主体在行使具体权利时,多个权利无法同时得到满足的互相矛盾、互相抵触的法律现象。权利冲突的原因在于利益冲突、立法缺陷和权利内容的复杂性,应当通过立法的方式预防权利冲突的发生或事后通过私力救济、司法救济的方式解决权利冲突。As phenomenon. the process of rule by law is advancing in China, rights conflict has become If we can not resolve the problem of rights conflict, modernization of rule by a common law will be es are contradictory or in conflict when they exercise their rights. The origin of conflict results from interests conflict, imperfection of legal system, fuzziness of rights. We should resolve rights conflict by legislation, private relief, judicial relief and so on.
