摘　　要：目的犯是一种没有特定目的便无法构成特定犯罪的一种犯罪形态,是以超过的主观要素为罪责要素的犯罪。在我国《刑法》中既存在法定目的犯的规定,又存在非法定目的犯的规定。目的犯的目的在我国目前通行的犯罪论体系中是作为与故意并列的犯罪主观方面的一个构成要素而存在的。对目的犯的一些特殊犯罪形态的研究,对刑法理论的充实和司法实践的指导均有重要作用。Purpose committed as a crime, have different characteristics of other crimes, criminal law theory needs to be due attention.
