摘  要:结合石化领域具体案例对专利中技术思想的延伸保护、实现方式及影响因素进行讨论。指出以某一特定的专利中技术思想为平台,可能引发高度相关专利的成群出现,呈现明显的专利"簇"的特征。而专利可能为申请人带来的最大利益通常源于"簇",而非单个专利的价值。重视专利中技术思想的延伸保护的目的就在于追求这种利益的最大化。In this article, the means to achieve extended protection of the core concept of the invention and related influencing factors are discussed based on some cases related to the development of catalysts and new processes in the petrochemical area. It can be seen from these examples that by using the specific fundamental ideas of an invention as a platform, a family of patents could be initiated. A cluster of related patents around the core concept instead of a single patent could bring the maximum return for the applicants. The goal of extended patent protection through a cluster of patents is to bring the maximized return to the applicants on the fundamental concept.
