数字图书馆视角的开放存取机制及著作权授权制度的优化

摘　　要：针对目前"保留所有权利"的版权授权声明方式导致网络作品无法得到最大价值的利用或最广泛传播的现状,介绍开放存取制度的产生原因和发展,分析开放存取制度的理念。指出我国著作权法在理论和实践上可以借鉴开放存取制度的相关理念,重新构建著作权授权制度,解决传统著作权授权模式在数字图书馆所遇到的诸多问题。In view of the current status that network works can not be the greatest value or most widespread used caused by the copyright authorization statement of ＂all rights reserved＂, the paper introduces the development and the cause of Open Access （OA） system, and analyzes the idea of OA system. The authors point out that China＇s copyright law can learn from the OA system related ideas in theory and in practice and reconstruct the copyright authorization system to solve the license problems in the digital library.
