摘  要:由于业主大会是按照"少数服从多数的原则"进行表决,少数业主的合法权益容易被多数业主侵害,我国应当建立相应制度保护少数业主的合法权益。在事前防范方面,我国应当建立和完善业主知情权制度、临时业主大会召集请求权与自行召集权制度、业主投票权代理制度、大业主投票权限制制度、累积投票制度、少数业主特别否决权制度。在事后救济方面,我国应当完善业主诉讼制度以解决我国《物权法》第78条第2款的实施问题。Since a general meeting of owners casts votes in accordance with the principle 'the minority is subordinate to the majority' rights and benefits of minority owners are easily infringed by majority owners and China should establish relevant systems for protecting lawful rights and interests of minority owners.In terms of prevention,China should establish and perfect such systems as the system of owners' rights to learn the truth,the system of claim for convening a owners' temporary general meeting and owners' right of self-convening a owners' temporary general meeting,the agency system of owners' voting rights,the restricting system of majority owners' voting rights,the accumulated voting system and the system of minority owners' special veto.In terms of remedies,China should perfect the system owners take a lawsuit in order to solve the problem of implementing the second paragraph of Article 78 in Property Law of P.R.C.
