浅析我国民族自治地方的经济自治权及其行使的法律保障

摘　　要：在民族区域自治制度中,自治权是其核心的内容,对自治权从内容、范围到实施都应由法律明确地加以设定。自治权的确定和行使直接关系到民族自治地方的建设,关系到各民族的切身利益和权利的实现,因此《民族区域自治法》对民族自治机关的自治权作了专章的规定,从各方面明确了自治权的内容。民族自治地方的自治权,包括了民族自治地方自治条例、单行条例的制定权,经济权,教育、科学、文化的建设权,治安权等多项内容。在这些自治权中,经济自治权是民族自治地方进行各项建设的物质保障,对其加以界定、予以行使并给予法律保障,对民族自治地方的建设和发展具有非常重要的意义。本文意图通过对民族经济自治权的定义、内容及其行使的法律保障等方面进行探讨,为我国民族法理论的完善尽微薄之力。In the minority concentrated regional autonomous system, autonomy is the core and it should be set definitely from the aspects of content, range and execution. The establishment and execution of autonomy directly relate to the building of the autonomous local authorities and the realization of the minorities＂ interest and right, therefore, the autonomy of minorities＂ autonomous authorities has been specially stipulated in the Minorities＂ Regional Autonomous Law, and the contents of autonomy are defined in all aspects, including the constitution power of autonomous regulations and specific regulation in minority autonomous regions, economic autonomy, building power of education, science and culture, public security power, and so on. Among these autonomies, the economic autonomy provides material guarantee for the buildings of minority autonomous regions, so we should define and execute it and safeguard it by law, and it will be of great significance to the building and development of local autonomous minorities. The author discusses on the definition and contents of minorities＇economic autonomy, and the legal guarantees for the execution of it, and so on, trying to make a contribution to the perfection of the theory of our national law.
