摘　　要：非物质文化遗产保护是我国建设社会主义和谐文化的基础工作,政府在其中处于主导地位。通过法律明确政府的职权职责是必要的,但规范政府的行为过程,加强对政府行为的法律监督,对我国非物质文化遗产保护来讲尤其重要。《非物质文化遗产保护法》应加强对后两者的规定,才能充分、有效发挥政府在非物质文化遗产保护中的主导作用,促进我国非物质文化遗产的保护、利用和传承。The protection of Chinese intangible cultural heritages is the foundation of constructing the harmonious culture of socialism in China, in which the government plays a dominant role. Although making governmentg duties clear through legislation is necessary, regulating the goverumentg actions through legal supervision is especially important for the protection of .Chinese intangible cultural heritages. 《The Protection Law of Chinese Intangible Cultural Heritages 》should clarify such responsibilities to promote the government＇s leading role in the protection, utilization and inheritance of these intangible cultural heritages.
