摘　　要：在现代侵权法的发展中,损害分散理念扮演了重要角色,同样也直接推动了船舶污染侵权法的形成。以损害分散为中心,船舶污染侵权法达成了船东和货主的妥协,以及施害人和受害人的平衡。The idea of loss spreading has played an important role in the development of modern tort law. Meanwhile it facilitated the formation of vessel-based pollution tort law. Based on the idea of loss spreading, vessel-based pollution tort law has been constructed as the result of a balance between the competing interests between the shipping and the oil industry, and the tortfeasor and the victim.
