摘  要:反向就业歧视是和普通就业歧视相对应的,其表现形式为对特定劳动者群体的特别保护、照顾和优惠措施。虽然对于反向就业歧视的公平与有效性,理论与实践中一直存在争议,但反向就业歧视在国际法和各国国内法中都已经有广泛的体现。我国应当从公平的角度认识和建立完备的反向就业歧视制度。Reverse discrimination is opposite to common employment discrimination and it performs as special protection, care and privilege for particular labor groups. International and domestic laws in various countries have provisions for reverse discrimination. It' s a hot dispute on fairness and validity of reverse discrimination in theory and practice, but reverse employment discrimination system is popularly embodied in the laws of many countries. China should recognize and establish complete reverse employment discrimination system from the angle of fairness.
