摘　　要：歪曲、篡改与戏仿非物质文化遗产是严重损害传承人精神利益的行为,其危害性远大于未经授权的无偿复制、散发、表演等行为。此类行为不仅破坏文化价值体系、影响民族团结,而且阻碍和谐社会的建设进程。非物质文化遗产的群体性、活态性和人格优位等特点,决定了它比现代著作权作品更易受侵害,而其客体的广泛性、复杂性,又决定了歪曲、篡改等行为表现形式的多样性,未来的立法应当着重在行为认定标准、法律责任等方面做出明确的规定。To distort, misrepresent and parody the intangible culture heritage is a serious behavior,which damage the successor＇ s spirit benefit. The harmfulness was far bigger than copying, spending and performing what without authoritative gratuitous. These behaviors not only destroy the system of culture value, affect the national unity , but also block the course of harmonious society. But its characteristics, such as group, alive and excellent place of personality being not a matter cultural heritage, decide it is easier to be encroached on than modem copyright work. Its object characteristics such as universality, complexity, decide the diversity of such behavior as distorting. Future legislation should set mind on aspecs such as standard , legal liability.
