摘 要:随着我国土地市场的逐步发育与完善,土地租赁制度作为国有土地有偿使用的一种重要方式,其优势日趋凸显。同时,也对土地二级市场起到了有益的牵带作用,越来越受到供用地双方的青睐。城市土地年租制相对于批租制具有明显的合理性,但该制度在我国尚处于探索阶段,仍然存在许多不尽完善之处。因此,从土地租赁制的缘起出发,在明确其优势的同时,分析相关法律上年租制存在的问题,进而论证建立土地使用权租金法律规制的必要性,对于大力推进国有土地租赁使用方式,推进租赁有偿用地制度具有十分重要的现实意义。The land tenure system of compensation as an important way for the use of state-owned land,with the development of our country land market to gradually improve,its advantages become more prominent,more and more land being available for the favor of both sides,it also played a useful role with the lead lands for the secondary market.Annual rent of urban land system has obvious rationality and superiority to the leasehold system,but the system is still at the exploratory stage in our country,there is still not much improvement.Therefore,from the origin of the land leasing system and know the advantages,analysis of the relevant issue of annual rent system in laws,further more to argues that the necessary for legal regulation fight to set up land-use rents,which is strongly recommend use of state-owned land lease and promoting the lease paid have a great practical significance.
