摘　　要：保护非物质文化遗产不能以牺牲改革开放的大好局面为代价,不能落入"人权"论者的圈套。传统文化在市场经济形势下的尴尬局面乃文化变迁规律之必然结果,但尊重文化发展规律与保护文化遗产并不矛盾,关键是要防止保护理念的情绪化。将传承优秀文化理解为复兴传统文化,由此出现了极端的产权化、政治化倾向都是情绪化的表现。文化发展规律决定了非物质文化遗产的保护必须有赖于政府行为,但政府的行为不能违背市场规律,不能强制性的挽救,而是应当因势利导挖掘遗产持有人主动传播文化的积极因素。The protection of the intangible cultural heritage should not be performed with the sacrifice of the achivements of Chinese opening and reforms, nor trapped in the so-called human right plot. The traditional culture is expected to come across the dilemma resulted from the constant changing culture in the context of the market economy. Respect of culture and protection of the intangible cultural heritage do not contract, but the point is prevention of giving in to the feeling, the extreme sense of intellectual property right, and political tendencies.
