摘　　要：根据《物权法》的规定,从法定共有与约定共有两个方面对小区车库、车位归属问题进行了分析,认为住宅小区停车位的归属既不能完全归属小区业主所共有,也不能一概认定归开发商所有,应视实际情况而定。The paper analyses the ownership of parking places and garages in community by the stipulations of ＂Property Law＂, in two aspects, namely, common ownership by law and common ownership by agreement.By analysis we hold that who should own the ownership of parking places and garages depends on the real situation.
